Terms of Service for Obsidian Ride
These terms explain how Obsidian Ride Inc. handles chauffeur-service quotes, reservations, payments, cancellations, airport pickups, waiting time, passenger responsibilities and service-related claims.
Agreement and Scope of Service
These Terms of Service form an agreement between Obsidian Ride Inc. (“Obsidian Ride,” “we,” “us” or “our”) and the person or organization requesting, booking or paying for transportation (“you” or “the customer”).
Obsidian Ride arranges pre-booked chauffeur, airport transfer, corporate transportation, hourly chauffeur, point-to-point, wedding, event, long-distance, group and approved cross-border transportation. We do not provide street-hail or immediate rideshare service.
By accepting a written rate, confirming a reservation, paying an invoice or using a confirmed service, you acknowledge that you have reviewed and accepted these terms. If you book for another passenger, you are responsible for making the applicable trip terms available to them.
You must be at least 18 years old and legally authorized to make a reservation or enter into an agreement on behalf of the paying party.
Rate Requests and Reservation Confirmation
Submitting a website form, sending trip details or speaking with our team requests a rate and availability review. A request does not automatically reserve a chauffeur or vehicle.
A standard reservation process is:
- Rate request: You provide the route, date, time, passengers, luggage and applicable service requirements.
- Review: Obsidian Ride reviews availability, vehicle suitability, timing and pricing.
- Rate acceptance: You approve the rate and trip details.
- Written confirmation: We send confirmation by email, text message, WhatsApp or another agreed written channel.
The vehicle is reserved only after the rate has been accepted and written confirmation has been issued. If a detail in the confirmation is incorrect, you must notify us promptly.
Quote Validity and Trip Changes
Unless the written quote states otherwise, a quoted rate remains available for acceptance for 28 days. A valid quote does not guarantee vehicle availability until written confirmation is issued.
A quoted or confirmed rate applies only to the itinerary and service details on which it was based. The rate may require review if you change:
- The pickup or destination.
- The pickup date or time.
- The number or duration of stops.
- The requested service duration.
- The passenger or luggage quantity.
- The requested vehicle category.
- Airport, event, accessibility or cross-border requirements.
We will communicate any revised rate before confirming a material change whenever reasonably possible.
Rates, Taxes and Additional Charges
All website and written transportation rates are shown in Canadian dollars (“CAD”) unless another currency is expressly identified.
Your written rate or confirmation will identify the trip details and explain which charges are included. Depending on the reservation, these may include or separately identify:
- Harmonized Sales Tax (“HST”).
- Chauffeur gratuity.
- Airport access or pickup fees.
- Tolls and border-related charges.
- Parking.
- Meet-and-greet service.
- Child seats or accessibility arrangements.
- Additional stops.
- Waiting time beyond the included period.
- Special-event, seasonal or third-party facility charges.
Once confirmed, a rate will not be increased solely because demand has risen. A confirmed rate may change when the customer changes the itinerary or when a charge not reasonably known in advance is requested or incurred and is permitted by these terms.
Payments, Invoices and Refund Timing
Obsidian Ride may accept payment through an online payment link, credit or debit card, cash, cheque or approved corporate invoicing arrangement. Available methods may depend on the reservation.
Payment timing and any authorization requirement will be stated in the written confirmation or invoice. Unless a deposit or advance payment is clearly stated and accepted before confirmation, requesting a rate does not create a payment obligation.
By providing an approved payment method, you authorize payment of the confirmed rate and any additional amount that you later request or approve under these terms.
Corporate accounts remain subject to approved invoicing contacts, spending authority and payment terms confirmed in writing. A corporate agreement does not reduce the passenger protections stated in these public customer terms.
When a refund is approved, Obsidian Ride will initiate it within five business days. Your financial institution may require additional time to display the credit. Some payment reversals may appear sooner.
Cancellations and Rescheduling
Cancellation and rescheduling requests are measured using Eastern Time (“ET”), which may be Eastern Standard Time or Eastern Daylight Time depending on the date.
- Three hours or more before pickup: Cancellation or rescheduling is free when the request is received and acknowledged by Obsidian Ride at least three hours before the scheduled pickup.
- Less than three hours before pickup: A late cancellation charge of up to 2% of the confirmed base transportation charge may apply.
- Exceptional circumstances: Management may waive a late-cancellation charge after reviewing the circumstances.
- Flight-driven changes: When a submitted flight is delayed or arrives early, the corresponding airport pickup timing is adjusted without a rescheduling fee.
Contact dispatch directly if you do not receive acknowledgement of a cancellation or rescheduling request. A message that is not delivered or cannot be connected to the correct reservation may not effectively cancel the trip.
Airport Transfers and Flight Monitoring
Flight monitoring requires the correct airline and flight number. When those details are supplied, dispatch may use the flight’s operating status to coordinate the pickup rather than relying only on the originally scheduled arrival time.
For international airport arrivals, the flight’s recorded actual landing time is used to begin the included waiting period unless the written confirmation provides a different instruction.
Flight monitoring supports pickup coordination but does not guarantee access to complete or error-free airline, airport or third-party flight data. You should contact dispatch if your flight changes, diverts, is cancelled or is replaced with a different flight number.
Airport pickup procedures vary by airport, terminal and service type. The terminal-specific instructions in your written confirmation take priority over general information displayed elsewhere on the website.
Included and Additional Waiting Time
- Airport arrivals: 60 minutes of waiting time is included.
- Other pickups and requested stops: 45 minutes of waiting time is included.
- Additional waiting: After the included period, waiting is charged at $5 CAD for every started 25-minute period.
- Total waiting limit: Waiting is limited to a maximum of 90 minutes from the time the applicable waiting clock begins.
Continued service beyond the 90-minute waiting limit is subject to chauffeur availability and dispatch approval. If continued service requires a new rate, it will be communicated before the extension whenever reasonably possible.
Chauffeur Arrival, Contact Attempts and Unreachable Passengers
The chauffeur or dispatch team will send an arrival or coordination message using the contact information provided for the reservation. The customer is responsible for providing a reachable telephone number and monitoring the agreed communication channel.
Airport rules may prohibit a vehicle from waiting continuously at the terminal curb. When applicable, a pre-arranged terminal desk, designated door or numbered curbside zone may be used, and the vehicle may be called forward only after contact with the passenger.
If the passenger cannot be located or contacted, Obsidian Ride may make up to nine telephone-call attempts and nine message attempts during the applicable waiting period.
If the passenger remains unreachable when the 90-minute total waiting limit expires, the reservation may be closed automatically. No separate cancellation or no-show fee will be charged solely because the passenger could not be reached under this process.
Vehicles, Passengers and Luggage
Vehicle recommendations depend on the passenger count, luggage quantity, accessibility requirements and service details provided by the customer.
Passengers and belongings can be carried only when they fit safely within the confirmed vehicle’s seating, restraint and luggage capacity. Luggage may not block exits, obstruct the chauffeur or create an unsafe condition.
If the information supplied at booking is incomplete and the confirmed vehicle cannot safely accommodate the passengers or luggage, transportation may be delayed or declined. An additional or larger vehicle may require a revised rate.
We make reasonable efforts to provide the requested vehicle. When a specific vehicle becomes unavailable because of maintenance, safety, mechanical or operational circumstances, we may offer an equivalent or upgraded vehicle without an additional vehicle-category charge. A materially different substitute will be communicated when reasonably possible.
Child Seats, Accessibility and Medical Transportation
Child seating must be requested in advance. Provide the child’s age, approximate size and seating requirements so availability and the appropriate arrangement can be reviewed. All passengers must use safety restraints as required by applicable law.
Passengers travelling with a wheelchair, mobility aid, service animal or other accessibility requirement should notify us before confirmation. Some vehicles can carry folded mobility equipment but may not provide ramp access or specialized securement systems. Required arrangements must be confirmed in writing.
Obsidian Ride’s medical transportation service is non-emergency passenger transportation. It does not provide ambulance service, medical monitoring, treatment or emergency assistance. In a medical emergency, call 911 or the applicable emergency service.
Passenger Conduct and Safety
Passengers must follow applicable law, use available safety restraints and comply with reasonable chauffeur instructions concerning safe vehicle operation.
The following are prohibited:
- Smoking or vaping inside any vehicle.
- Possessing or consuming illegal drugs.
- Carrying unlawful weapons or dangerous materials.
- Harassment, threats, violence or abusive behaviour.
- Interfering with the chauffeur or safe operation of the vehicle.
- Intentional damage or excessive soiling.
- Alcohol consumption where it is unlawful or has not been expressly permitted for the applicable vehicle and service.
A chauffeur or dispatcher may refuse to begin or may safely terminate a journey when conduct creates a safety risk, violates the law, threatens another person or may materially damage the vehicle. Charges for transportation already provided and reasonable costs already incurred may remain payable, subject to applicable consumer law.
Vehicle Damage and Cleaning
The customer responsible for the reservation may be charged the reasonable cost of repairing passenger-caused damage or completing cleaning beyond what is normally required after transportation.
This may include damage to seats, doors, windows, interior fittings or equipment, as well as specialized cleaning required because of smoking, bodily fluids, spills, food, excessive waste or prohibited substances.
When a charge is requested, Obsidian Ride will provide reasonable supporting information and an itemized amount. Ordinary vehicle cleaning and normal wear are not chargeable passenger damage.
Partner Operators and Subcontracted Transportation
Obsidian Ride may use an authorized transportation partner when necessary to provide a confirmed trip, specialized vehicle, group service or out-of-area journey.
The same written rate and applicable customer policies remain in effect when a partner operator completes the trip. Necessary reservation information may be shared with that operator so the service can be provided.
Obsidian Ride remains the customer’s primary booking and service-contact point unless the written confirmation clearly states otherwise.
Delays and Events Outside Reasonable Control
We plan confirmed transportation with reasonable care, but exact travel and arrival times cannot be guaranteed where conditions are outside reasonable operational control.
Examples include:
- Severe weather or unsafe road conditions.
- Traffic collisions or unexpected congestion.
- Road, bridge, tunnel or border closures.
- Police, emergency-service or government restrictions.
- Airport closures, security incidents or airline disruptions.
- Mechanical problems that could not reasonably have been prevented.
- Events, demonstrations, construction or restricted venue access.
- Natural disasters or other force-majeure events.
When such an event occurs, we will make reasonable efforts to communicate, reroute, adjust timing or arrange a suitable replacement. Safety takes priority over the requested schedule.
Long-Distance and Cross-Border Travel
Customers and passengers are responsible for carrying valid passports, visas, permits and any other documents required for the planned journey.
Obsidian Ride cannot guarantee admission across an international or provincial border, border-processing time or the actions of customs, immigration or law-enforcement authorities.
Passengers must not carry prohibited, undeclared or unlawful goods. Border delays, additional stops, overnight requirements or itinerary changes may affect chauffeur availability and the written rate. Any known cross-border charge should be disclosed before confirmation whenever reasonably possible.
Personal Belongings and Lost Property
Passengers are responsible for checking that they have collected their luggage, documents, electronics and other belongings before leaving the vehicle.
Report a missing item as soon as possible. We will make reasonable efforts to locate property reported as lost, but recovery cannot be guaranteed. Delivery, shipping, storage or chauffeur travel required to return an item may involve a reasonable charge disclosed before return.
Obsidian Ride is not responsible for ordinary loss, theft or damage to unattended property except to the extent caused by proven negligence or where liability cannot legally be excluded.
Promotions and First-Ride Discounts
A publicly advertised first-ride promotion may provide an eligible new customer with a 10% discount after the required promotional code is applied to the qualifying reservation.
Unless the applicable promotion states otherwise:
- The code must be provided before written confirmation.
- The offer is limited to one qualifying first completed ride.
- The offer cannot be exchanged for cash.
- Multiple promotional offers cannot be combined.
- The written rate will identify the amount to which the discount applies.
A promotion does not reserve a vehicle or override availability, safety requirements or these customer terms.
Service Failure, Replacement and Refund
If Obsidian Ride cannot provide a confirmed journey because of a service failure within our responsibility, we will make reasonable efforts to arrange a suitable replacement.
If a suitable replacement cannot be provided or is not accepted because it materially differs from the confirmed service, the customer may receive a full refund of the amount paid for the affected service.
A service concern should be reported promptly with the reservation reference, trip date and relevant details so it can be reviewed. Approved refunds are initiated within five business days.
Limitation of Liability
To the fullest extent permitted by law, Obsidian Ride is not responsible for indirect, incidental, special or consequential losses arising from circumstances outside our reasonable control, including missed flights, appointments, events, business opportunities or onward connections.
Where liability can legally be limited, our aggregate liability for a transportation-related claim will not exceed the amount paid or payable for the affected confirmed service.
Nothing in these terms excludes or limits liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or any right or remedy that cannot legally be excluded under applicable consumer-protection law.
Privacy and Reservation Information
Personal information provided for a quote or reservation is handled according to the Obsidian Ride Privacy Policy.
Information reasonably required to provide transportation may be shared with dispatch personnel, the assigned chauffeur, an authorized partner operator, payment providers or other service providers.
Customers booking for another person are responsible for ensuring that they are authorized to provide that passenger’s contact and itinerary information.
Governing Law, Changes and Severability
These terms are governed by the laws of Ontario and the applicable federal laws of Canada, without limiting any mandatory consumer rights that apply in another jurisdiction.
If a provision is found unenforceable, the remaining provisions will continue to apply to the extent legally permitted. A failure to enforce a provision on one occasion does not waive the right to enforce it later.
We may update these terms for future rate requests and reservations. The version accepted when a reservation is confirmed will generally govern that reservation unless a change is required by law or is expressly accepted by both parties.
A booking-specific written confirmation forms part of these terms. Where it expressly identifies a different trip detail, vehicle, timing, rate or included service, the accepted written confirmation controls that specific detail.
